Understanding Property Division in a Divorce
In a divorce, the court will decide how to equitably divide any assets and liabilities of the marriage. This includes property acquired during the marriage and debts incurred during the marriage. Property includes all assets and property acquired during the marriage, such as real property (e.g., the marital home), personal property (e.g., cars, furniture, clothing), and financial assets (e.g., bank accounts, retirement plans, investments, and debts).
While the court will take many factors into account when determining how to divide the property, it will focus on the factors set forth in Tennessee Code Annotated Section 36-4-113.
Factors the Court Will Consider When Dividing Property
