Understanding Property Division in a Divorce
In a divorce, the court will decide how to equitably divide any assets and liabilities of the marriage. This includes property acquired during the marriage and debts incurred during the marriage. Property includes all assets and property acquired during the marriage, such as real property (e.g., the marital home), personal property (e.g., cars, furniture, clothing), and financial assets (e.g., bank accounts, retirement plans, investments, and debts).
While the court will take many factors into account when determining how to divide the property, it will focus on the factors set forth in Tennessee Code Annotated Section 36-4-113.
Factors the Court Will Consider When Dividing Property
- the respective financial conditions of each spouse at the time of the dissolution
- the standard of living established during the marriage
- the contribution by one spouse to the other's education, training, or increased earning power
- the contribution of each spouse to the acquisition of property, including the contribution of a spouse as a homemaker
- the need of one spouse based on the spouses' standards of living and the other's ability to pay
- the obligations and rights of each spouse and the marital property interest of each
- any written agreement of the parties
These factors are not necessarily weighted equally. However, if the court determines that one spouse's financial situation is significantly better than the other's, the court may order the higher-earning spouse to pay the lower-earning spouse permanent periodic alimony. The court will also take into consideration any other factors it deems relevant in making its determination, such as how long the couple was married, the age and health of the parties, and any evidence of domestic violence.
In addition to dividing the marital property, the court will also award parenting time and responsibility based on what is in the best interests of the child. If you are concerned about your child's financial future, custody and visitation are important considerations.
